Abstract
Background. The article focuses on implementing wage indexation on the basis of the current requirements of labor legislation established in Article 134 of the Labor Code of the Russian Federation. The significance of wage indexation mechanisms is assessed for increasing the real money incomes of the population from primary employment (employment income), which in turn will contribute to improving the living standards of the population in the Russian Federation as a whole and in its constituent entities. The article concludes that it is necessary to improve the legal norms on wage indexation taking into account the interests of employees, financial and economic capabilities of employers, and other economic and social factors. The aim of the study is to analyze the existing legal challenges of wage indexation and to formulate the directions for improving public legal regulation of wage indexation. Materials and methods. The aim is achieved through reviewing research literature on legal regulation of wage indexation and examining judicial practice of considering relevant disputes. The methodological basis of the study is a set of general and specific scientific methods of studying phenomena and processes, such as materialistic, historical legal, systemic legal, comparative legal and other methods. Results. The article analyzes the challenges of law enforcement of labor legislation provisions on wage indexation under the current legal regulation. The substantial characteristics of the concept of wage indexation are outlined with regard to the legal and economic components of wage indexation. Conclusions. The study shows that the current public legal regulation of wage indexation requires fundamental changes. There is an urgent need to provide a legal definition of wage indexation. Minimum differentiated criteria for wage indexation should be established, taking into account the financial and economic capabilities of employers on the one hand and the economic interests of employees on the other. The mechanism of wage indexation should reflect a variety of economic and social factors related to industrial and regional features of wage policy, as well as the potential of the social partnership system at the industrial and regional levels should be exploited.
